Garcia Subject: Unions withdrawal from HPWO dated 17 February 2005 The Union feels that the atmosphere of mutual trust and respect that existed between the Union and NewTec as a Company has deteriorated to a point of non existence. Furthermore, your cavalier disregard for the welfare of its employees and IAM members no longer promotes a positive and mutually beneficial workplace that’s conducive to us having a HPWO relationship. The activities undertaken by the Company to circumvent the provisions of the Collective Bargaining Agreement which is a binding contract reflects the lack of respect for the IAM and its members. Therefore, please be advised that
effective immediately the IAM LL-2515 is withdrawing from the HPWO

The CBA in Article Thirty-Five, section 1.02, the Arbitrators decision shall be final and binding. NewTec chose not to abide by this article in the CBA as it was written. Health Insurance plan modifications. The Company chose on their own not to notify and meet with the Union as soon a possible to discuss Health insurance plan modifications IAW Appendix A of the CBA. NewTec’s unwillingness to train employees in HPWO.
